Fair Use Policy

This Fair Use Policy applies to Connected Australia Services.

It is important to Connected Australia that all eligible Connected Australia customers can access our Services. Accordingly, a Fair Use Policy have been devised which applies to:

(a) using Connected Australia Services and Plans; and

(b) any promotions or services advertised by Connected Australia as subject to the Fair Use Policy (“Fair Use Promotions”).

We reserve the right to change the terms of the Fair Use Policy from time to time. Connected Australia may rely on the Fair Use Policy where:

(a) your usage of Connected Australia Services is unreasonable; or

(b) your involvement in a Fair Use Promotion is irrational or excessive, as defined below:

Unreasonable use

It is an unreasonable use of Connected Australia Services where your use of our services is reasonably considered by Connected Australia to be excessive, fraudulent or to adversely affect the Connected Australia Network or other customers’ use of or access to a Connected Australia Service or the Connected Australia Network.

It is an unreasonable use of a Fair Use Promotion where Your participation in a Fair Use Promotion is reasonably considered by Connected Australia to be excessive, fraudulent or to adversely affect the Connected Australia network or another Connected Australia customer’s use of or access to a Connected Australia service or the Connected Australia network.

Among other things, “fraudulent use” comprises the resupplying a Connected Australia Service without Connected Australia’s consent so that someone else may access or use Connected Australia Data Services or take advantage of a Fair Use Promotion.

Our rights

If You are in breach of this Fair Use Policy, Connected Australia may contact you to discuss on changing your usage so that it conforms to this Fair Use Policy.

If, after Connected Australia has reached you but your excessive or unreasonable use continues, Connected Australia may, without further notice be:

(a) suspend or limit the service (or any feature) for as long as we think reasonably necessary;  and/or

(b) terminate Your agreement with Connected Australia.
